ENTERCOM/GET MY PERKS – BIRTHDAY BASH
Official Contest Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Who Can Enter
1.Eligible entrants must be legal U.S. residents of one of the 48 contiguous states and 18 years of age or older on date of entry.
2.Employees (including, without limitation, part-time or temporary employees) of Contest Administrator (defined below) and its respective parent entities, subsidiaries, affiliated companies and advertising and promotion agencies at any time during the applicable contesting period and the immediate family and other household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners, siblings (half and full) and the steps of each of the foregoing) of each of the above are NOT eligible to enter and/or to win this Contest.
How to Enter
3.To enter from 12 AM (ET) on July 9, 2012 through 11:59 PM (ET) on July 22, 2012 visit the Facebook fan page of any of the twenty-four (24) participating local Get My PERKS affiliates (see Attachment A for complete list) and click the graphical “Birthday Bash” contest link (“Participating Pages”).
4.The entry/registration process will require you to 1) either log into your existing Facebook account, or create a free Facebook account and 2) “Like” the Facebook “fan page” of that specific Get My PERKS affiliate. An existing Get My PERKS account is not required to participate in this contest.
5.Complete the required sections of the online entry/registration form by submitting the Entrant’s first name, last name, e-mail address, phone number, postal code, and birthday (month/day). The Entrant may provide, at his/her choosing, additional optional information requested on the entry/registration form.
6.Entrants are limited to one original contest entry per e-mail address on each of the Participating Pages. After entry has been received, entrants will receive a personalized link to share with friends. If friends of the entrant use the specific invitation link sent as a result of that entrant’s entry in this contest, then opt to “like” the Participating Page associated with the special invitation link, and successfully enter this Contest themselves, the entrant who shared the contest with them, will get one (1) additional entry into this contest for each such friend. A person who enters through a link from an entrant inviting them to enter this contest cannot later enter the contest again as a result of a subsequent invitation to enter from a different entrant.
7.By participating and submitting an entry, entrants agree that Contest Administrator and participating parties (including, Get my PERKS and our associated radio station) are authorized to contact entrant via email, mail, phone or any other form of media to make participant aware of information pertinent to the contest , and to distribute information and solicitations regarding the featured products, special events or promotional offers, or purchase incentives. Entrants may opt-out of any further email communication at any time by simply replying REMOVE to any email message, or following the provided opt-out instructions.
8.All entries become the property of Contest Administrator and will not be acknowledged or returned. Entries received that are mutilated, tampered with, illegible, or from ineligible entrants will be void. Entries that are determined to be fraudulent will be void, in Contest Administrator’s sole discretion on a case by case basis. Incomplete entries may be disqualified in Contest Administrator’s sole discretion.
How to Win
9.On Monday July 23, 2012, one (1) Entrant will be randomly selected from among all of the qualified entries received on each of the twenty-four (24) participating local Get My PERKS affiliate fan pages (each a “Qualifier”) for a total of twenty-four (24) nationwide Qualifiers, one randomly selected from each Participating Page entrants. These Qualifiers are NOT entitled to any prize in this contest and will NOT be notified that he/she is a Qualifier.
10.Later on Monday July 23, 2012, one (1) Qualifier will be randomly selected from among the twenty-four (24) nationwide Qualifiers as the one grand prize winner of this contest, subject to verification of eligibility and compliance with these contest rules. The potential winner’s name may be posted on each of the participating local Get My PERKS affiliate Facebook fan pages and online at http://etm.getmyperks.com/bash.
11.In no event is any entrant, Qualifier or winner entitled to any prize in this Contest until his/her identity, eligibility and compliance with these Contest rules has been confirmed by Contest Administrator, notwithstanding any and all use of the term “winner” or similar terms with respect to that selected entrant (including, without limitation, on Get My PERKS web pages or Facebook fan pages listing “winners”).
12.Proof of submitting entries will not be deemed to be proof of receipt by Contest Administrator. Each participant must submit an entry on his/her own behalf. Any entry submitted on behalf of another individual or using another person’s email address or name will be disqualified and ineligible to claim any prize.
Prize
13.There will be one (1) prize awarded in this contest to the verified winner. The prize will be a Trip for Two (2) to New Orleans,” valued at approximately $1275, including and subject to the following:
•All travel must be completed by September 30, 2012.
•Two (2) Delta Airlines travel vouchers provided by Orbitz each valid for redemption online at www.Delta.com for roundtrip airfare for one (1) individual per voucher limited to Delta Airlines destinations within the 48 contiguous US States and Canada with 7-day advanced booking based on availability and holiday/blackout date use restrictions, each subject to the winner’s payment of a $10 per ticket 9-11 security fee, will not be replaced if lost, stolen or mutilated, may not be combined with any other offer, does not include ground transportation in departure or destination cities, winner will be solely responsible for applicable taxes, baggage charges, the cost of tickets or seat upgrades and any other charges incurred after or in connection with the use of these vouchers and each voucher expires October 10, 2012.
•One (1) Windsor Court New Orleans Hotel gift certificate valid for two (2) night accommodations in a full suite for two (2) and up to $200 toward dinner for two (2) in The Grill Room when the original certificate is presented at check-in, subject to availability with advanced reservations, excludes holidays, blackout dates and special events, will not be replaced if lost, stolen or expired, void if altered, photocopied or reproduced, does not include tax, gratuity or other applicable charges, may not be redeemed for cash, may require winner to present a major credit card for incidentals, expires on September 30, 2012 and is valued at $850.
•One (1) certificate valid toward dinner and drinks for two (2) at Galatoire’s Restaurant in New Orleans, not exceeding $200, not including include tax or gratuity, subject to availability, not redeemable for cash, and not replaceable if lost or stolen.
•Contest Administrator and sponsors are not responsible for replacing or reimbursing winners with any form of compensation for flights or events that are canceled, rescheduled or delayed. All cancellations are deemed beyond the control of Contest Administrator and its sponsors. This includes, but is not limited to, event cancellations, trip schedule changes, flight cancellations, changes in travel arrangements, travel delays of any form and duration, as well as all delays or cancellations due to acts of nature, terrorism (including threats), illness or war. Additionally, Contest Administrator is not responsible for any work stoppage, bankruptcy or other condition beyond Contest Administrator’s control that may affect Contest Administrator’s ability to provide any of the prizes. Contest Administrator is not responsible for any expenses incurred by contest winners as a result of such cancellations, delays or other circumstances beyond Contest Administrator’s control.
14.Winner is solely responsible for obtaining all necessary travel documentation and all ground transportation (including to/from departure airport, to/from hotel and airport in destination city and in/around destination city).
15.Prize will be mailed or emailed, as applicable, to the verified Winner by the Contest Administrator within thirty (30) business days of verification of eligibility and receipt of required documentation (see below) from applicable Winner.
16.The potential winner will be notified at the e-mail address he/she provided with his/her entry within three (3) business days of being selected as the potential winner of this contest. Contest Administrator will only be required to send one e-mail to the email address provided by the potential winner in his/her entry into this Contest. If the email is returned or not responded to, Contest Administrator will not be obligated to attempt any further contact.
17.Contest Administrator may require selected winning entrant to produce documentation (as determined in Contest Administrator’s sole discretion) evidencing eligibility in this Contest. Notwithstanding anything to the contrary in these rules or otherwise, in no event is Contest Administrator required to confirm eligibility or eliminate ineligible entrants prior to selecting winner. In the event that any selected winner is determined to be ineligible at any time, he/she will be disqualified and not entitled to any prize in this Contest. In such event, Contest Administrator may (but is not obligated to) select an alternative winner from among all other entries received, time permitting.
18.In the event the winner is disqualified or the prize is forfeited at any time, Contest Administrator reserves the right (but not the obligation) to select another winner in this contest (in Contest Administrator sole discretion).
19.Prize will be released to the winner only. Winner may be required to provide a copy of a valid United States state or federal photo ID and valid social security number in order to receive a prize. Winner (and, in the case of trip prizes, winner’s travelling companion(s)) may be required, in Contest Administrator’s sole discretion, to sign one or more liability release agreements relieving the Contest Administrator, its parents, subsidiaries, officers, directors, members, managers, employees, agents and contest sponsors or other parties from any and all liability with respect to the entrant’s participation in the contest and the receipt and/or use of any prize. Any person who refuses to sign any required liability release agreement, provide a social security number or complete and/or provide any other documents required by the Contest Administrator by the deadline required by Contest Administrator will forfeit any and all prizes.
20.Contest Administrator reserves the right to substitute a prize of equal or greater value. No transfer or assignment of prize is allowed, except as may be determined by Contest Administrator in its sole and absolute discretion on a case by case basis.
21.Winner is responsible for paying all applicable local, county, state and federal taxes on prize based on the estimated retail value of the prize, as set forth in the contest rules, and will be issued an IRS 1099 form for all prizes won from Contest Administrator where the aggregate value of all prizes is $600 or more in any calendar year.

22.This Contest is conducted, sponsored and administered by Entercom Communications Corp., 401 City Avenue, Suite 809, Bala Cynwyd, PA 19004 (“Contest Administrator”).
Odds of Winning
23.Odds of becoming a Qualifier depends upon total number of entries received through the Participating Page in which a particular entrant entered (and the number of different Participating Pages entered through). The Odds of a Qualifier winning the prize will be no greater than 1:24.
Other Rules that Apply to this Contest
24.All times in these contest rules are Eastern Standard Time (U.S.), unless a different time zone is expressly referenced.
25.Inquiries by contestants or potential contestants to the Contest Administrator (whether in person, by email, or by telephone) regarding the status of their entry or questions about this contest may or may not be responded to and Contest Administrator is not obligated to respond or treat to all inquiries identically (even if the question is identical). Time considerations and/or volume, among other things, may impact a Contest Administrator’s desire or ability to respond to such inquiries from time to time. Notwithstanding anything communicated by any Contest Administrator employee in connection with any such inquiry, such information shall not be binding on Contest Administrator (the sole determining information related to this Contest is as set forth in the applicable contest rules) and shall not be deemed to be providing any type of improper assistance or advantage to any particular contestant over another. Any attempt by Contest Administrator to respond to an inquiry will be in the context of providing good customer service only and, in some instances, to address technical issues/problems.
26.Winner is prohibited from selling prize awarded or any transferring prize without the Contest Administrator’s authorization (which authorization must be in writing by a Contest Administrator representative and shall be granted or withheld in Contest Administrator’s sole discretion on a case by case basis). In the event that Contest Administrator discovers or suspects (correctly or incorrectly) that a winner is attempting to sell his/her prize from Contest Administrator (i.e., eBay, Craigslist or otherwise), Contest Administrator reserves the right, in its sole discretion, on a case by case basis to take any one or more of the following actions: (a) immediately disqualify the winner and deem any prize they were otherwise entitled to as forfeited, or (b) refuse to award the prize to such winner, even if he/she represents that they will not resell or transfer the prize. Further, Contest Administrator reserves the right to track and/or cancel and invalidate any prize awarded that Contest Administrator suspects was sold or transferred without authorization.
27.Contest Administrator shall be the sole arbiter in all matters relating to the contest and in the interpretation of contest rules. Contest Administrator’s decisions shall be final. Entry into the contest constitutes agreement by contestants to abide by these rules, as well as any other rules established by Contest Administrator
28.In the event an identity dispute arises the entrant will be declared as the “authorized e-mail account holder” and any damage made to the website will also be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participants may be requested to provide Contest Administrator with proof that the participant is the authorized e-mail account holder of the e-mail address associated with the account/submission.
29.By participating in an Contest Administrator contest, entrants hereby agree and each entrant hereby remises, releases and forever discharges and agrees to indemnify and hold harmless Contest Administrator, its affiliates, parents, assigns, successors, employees, contest sponsors, agents and all others connected with them and the promotion, contest, and/or event from any and all liability, claims, actions, and damages sustained or incurred by participation in the said promotion, contest, and/or event and the receipt and use of any prize(s) awarded (if any) through such promotion, contest, and/or event arising in any manner whatsoever, including but not limited to an act or omission, whether negligent, intentional or otherwise caused by Contest Administrator, its affiliates, parents, assigns, successors, employees, contest sponsors, agents and all others connected with them and the promotion, contest, and/or event.
30.By participating in this contest, entrants hereby consent to Contest Administrator and prize providers, usage of any one or more of the following for online, social media, radio or television broadcast and/or for any other advertising and promotional purpose in any medium whatsoever without payment of any additional consideration: contestant’s name; voice; likeness; biographical information; his/her participation in the contest; and the substance of the entrant’s entry form. By entering this contest, entrants understand and agree that Contest Administrator may take photographs and/or videotape and/or audiotape any contestants participation, appearance and/or performance in connection with this contest (before, during or after the contest) and that Contest Administrator will own any such photos, audio and/or video and shall be free to utilize such materials in any way it sees fit during or after the contest with no compensation to the entrants, including without limitation posting any such photographs, audio and/or videos on its (or other) websites and/or social media websites.
31.Contest Administrator is not responsible for any technical difficulties, technical malfunctions or errors (whether technical or typographical) experienced due to overload, busy signals, loss of phone service, internet availability, electronic problems, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed, or misdirected transmissions, or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of any of the websites, computer virus, bug, or other errors or corruptions of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of information or the failure to capture, or loss of, any such information or any other factor that may prevent an individual from completing or Contest Administrator from receiving (accurately or otherwise) a phone call, an email, accessing any website (including the Contest Administrators or any third party website), or for any problem associated with the Contest Administrator website or software, internet, telephone connections, servers, routers, or any other technical problem that may impact entry, participation, or prize claim in any way, regardless of the cause, including, without limitation, any injury or damage to any person’s computer, equipment, property, software or network related to or resulting from participating in an Contest Administrator contest or visiting its websites (whether as an entrant or visitor). Contest Administrator and its prize providers assume no responsibility for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in a Contest Administrator Contest. Contest Administrator is not responsible for any printing errors or typographical errors. If, for any reason, in the sole opinion of Contest Administrator, this contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes, whether discovered or suspected by Contest Administrator, which, in sole opinion of Contest Administrator does or could corrupt or affect the administration, security, fairness, integrity or proper conduct of a Contest, Contest Administrator reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the affected contests with or without selecting winner, and/or provide alternative means of entry or any other changes to these contest rules that Contest Administrator deems appropriate under the circumstances. In the event of termination, suspension or modification of a contest, a notice will be posted online.
32.Contest Administrator reserves the right to prohibit the participation of an individual from any or all Contest Administrator contests if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in the applicable Contest rules. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, CONTEST ADMINISTRATOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW.
33.This contest is subject to all applicable laws and regulations and is void where prohibited.
34.Contest Administrator reserves the right to: (i) terminate or declare this Contest null and void and rescind any prize, if in its sole judgment, the rules or the integrity of the Contest have been violated or compromised in any way, intentionally or unintentionally by any person whether or not a participant in the Contest; (ii) alter or amend these Contest rules at any time; and (iii) stop or conclude the Contest at any time without prior notice. Material changes to the contest rules will be posted at www.getmyperks.com, when practical.
35.Winner List: For the name of the winner, mail a self-addressed stamped envelope to “Get My PERKS Birthday Bash Winner List” c/o Entercom Communications Corp., 401 City Avenue, Suite 809, Bala Cynwyd, PA 19004. All requests for winner lists must be mailed and received by Contest Administrator after July 23, 2012 but prior to December 31, 2012.
36.Facebook is in no way a sponsor, endorser or administrator of this contest and is not affiliated with Contest Administrator or this contest in any manner. Entry information provided in this contest is being provided to Entercom Communications, Get My PERKS and its affiliates, not Facebook.
